New Jersey attorney helps those accused of reckless driving

Many charges in New Jersey are often up to the discretion of the police officer involved. Often, these charges are based on a subjective judgment call of the officer, including careless or reckless driving. Unfortunately, people facing these accusations may be unaware of their options and may automatically plead guilty, but Mark Cheser, Esquire, Counselor at Law may be able to help .

There are a variety of different alleged actions that could potentially result in accusations of reckless or careless driving. These could include talking on a cellphone while speeding, eating, driving in a way determined to be erratic, passing a slow moving vehicle or ignoring  crosswalk, among others. Because these charges are often the result of an officer's judgment call, some charges could be reduced or dismissed following a hearing with the New Jersey Motor Vehicle Commission.

New Jersey state law defines reckless driving as displaying a "wanton disregard" of others, including their property, rights and safety. This charge often comes in conjunction with a speeding ticket, which could both result in up to 10 points on the person's driver's license. On the other hand, careless driving involves driving without "due caution" that endangers the property or well-being of others; it also results in points on a person's driver's license. If a driver accumulates more than 12 points in two years, his or her driver's license is automatically suspended.

Along with the points on the driver's license, a person can also face significant financial ramifications as insurance rates will likely be raised as well. In some situations, there may have been extenuating circumstances at play. An initial consultation with Mark M. Cheser, Esquire, Counselor at Law, can help those facing accusation of careless or reckless driving fully understand the options available to them.
