Woman crashes into New Jersey hatchery, charged with DWI

When driving late at night, it is easy for drivers to become disoriented. This can be true even when drivers are on a familiar path. Unfortunately, police in New Jersey have accused a driver of DWI after she allegedly drove her car into a fish hatchery.

The incident happened during the early morning hours of a day in mid-August. According to reports, someone contacted police about a vehicle described as "suspicious" at the Charles O. Hayford State Fish Hatchery. Police say when they arrived at the scene, they discovered a partially submerged vehicle.

Reports indicate that a woman was sitting on the trunk of the vehicle, waving at them for help. One officer claims that as he helped the 42-year-old woman, he could smell alcohol on her breath. Though it is unclear how officers determined the woman's blood alcohol content, she was charged with unauthorized vehicle in a park area and driving while intoxicated. Representatives from the New Jersey Departments of Environmental Protection indicate that the pond did not contain any fish stock at the time, and the accident did not result in any damage to the pond.

Unfortunately, the woman now faces some legal challenges as a result of the DWI allegations against her. In all criminal cases, there must be sufficient evidence to prove guilt beyond a reasonable doubt in order for someone to be convicted. It seems doubtful that a police officer's sense of smell alone is sufficient to meet this burden.
