New Jersey politician suing after DWI arrest

A politician alleges that his arrest was part of a police conspiracy. The New Jersey councilman was arrested for DWI in February, but he claims that he was unfairly targeted. After recent changes to police staffing guidelines, he felt that his relationship with the local authorities deteriorated. In the criminal case he was ultimately able to have the original charges against him dismissed, all except for a minor traffic violation. 

His recent lawsuit was revealed by an open government website and has recently begun to garner some attention. The councilman, Mr. Jerry Murphy, does not deny that he was drunk at the time he was stopped. His Breathalyzer results showed his BAC to be .13, which is over the legal limit of .08. He claims that he should have been stopped as he was leaving the bar instead of being allowed to drive away and then pulled over. 

The politician also claims that police lied on the police report, that they were not originally in the area where the man was driving, but had been tipped off by an ex-cop who was also in the bar where he was drinking. The attorney representing the police claims that the man is looking for a judge or jury to find that he should not have been arrested so that he can have an excuse for the incident. A motion has been filed to dismiss the suit. 

The man's criminal defense for the original DWI must have been convincing to the court. Instead of being saddled with drunk driving, careless driving, speeding and failure to maintain his lane, he pleaded guilty to a license plate violation and the other charges were dismissed.  An individual in New Jersey who feels that he or she has been unfairly charged with a crime may also seek justice under the law.
